This “Returns & Limited Warranty Policy” contains the ADC Solutions Auto, LLC (“ADC”) limited warranty, our return policy, and other information relevant to customers after purchasing BFGoodrich® wiper blades (“Wiper Blades”). By making a purchase of any Wiper Blades, you agree to be bound by this Returns & Limited Warranty Policy. If you are not eligible or do not agree to any of the terms of this Returns & Limited Warranty Policy, do not use the Wiper Blades. This Returns & Limited Warranty Policy is hereby incorporated into, and made a part of the Terms of Use. Capitalized terms used but not defined in this Returns & Limited Warranty Policy have the meaning given to them in the Terms of Use. We urge you to read and become familiar with the Terms of Use as they may affect your legal rights.

ADC MAKES NO WARRANTY OF ANY KIND WITH RESPECT TO THE WIPER BLADES OTHER THAN THE LIMITED WARRANTY PROVIDED UNDER SECTION 2, BELOW. 

1. Product Warnings
PLEASE REVIEW ALL OF THE WIPER BLADES WARNINGS FOR YOUR WIPER BLADES BEFORE USING THEM FOUND IN YOUR WIPER BLADES’S INSTRUCTION MANUAL. FAILURE TO COMPLY WITH THE WIPER BLADES WARNINGS WILL INVALIDATE THE BELOW LIMITED WARRANTY.

2. Limited Warranty
ADC warrants to the original owner-user of the Wiper Blades that during the Warranty Period the Wiper Blades will be free from defects in material and workmanship (the “Limited Warranty”). The Limited Warranty begins on the date of purchase of the Wiper Blades and lasts for one year (the “Warranty Period”). Claims of defect brought after the applicable Warranty Period will not be covered by this Limited Warranty.

2.1 Warranty Disclaimers
EXCEPT AS OTHERWISE SET FORTH HEREIN, WIPER BLADES ARE SOLD ONLY WITH THE LIMITED WARRANTY DESCRIBED HEREIN. No person or entity is authorized to (a) bind ADC to any other warranty, obligation, or liability for any BFGoodrich® product, including but not limited to the Wiper Blades (b) alter the Limited Warranty contained herein.

EXCEPT WHERE PROHIBITED BY LAW OR AS OTHERWISE PROVIDED HEREIN, ADC HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE. IN STATES THAT DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, INCLUDING WITHOUT LIMIATION THE IMPLIED WARRANTIES OR MERCHANTABILTY AND FITNESS FOR A PARTICULAR PURPOSE, ADC LIMITS THE DURATION OF SUCH WARRANTIES TO THE WARRANTY PERIOD. SOME STATES DO NOT ALLOW DISCLAIMER OF IMPLIED WARRANTIES OR LIMITATIONS HOW LONG AN IMPLIED WARRANTY LASTS, SO THE PORTIONS OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

2.2. Conditions of Limited Warranty
If your new Wiper Blades are found to be defective, ADC will replace such Wiper Blades during the applicable Warranty Period subject to the following conditions:
•    All claims under the Limited Warranty must be accompanied by a copy of the sales receipt, bill of sale, or other proof of purchase (collectively, your “Proof of Purchase”).
•    The Wiper Blades must not have been altered or damaged through:
•    negligence, accident, improper operation or handling, neglect, tampering, abuse, unusual physical stress, or failure to follow the product instructions for installation, use, or care;
•    incorrect or inadequate maintenance, cleaning, or care of the Wiper Blades; or
•    normal wear and tear of the Wiper Blades.
•    Replacements supplied by ADC under this Limited Warranty are protected only for the unexpired portion of the original applicable Warranty Period.
•    This is a “repair” Limited Warranty only, and does not cover costs related to the installation, removal, or reinstallation of the Wiper Blades.
•    Claims of defect brought after the applicable Warranty Period will not be covered by this Limited Warranty.
•    This Limited Warranty extends only to the original purchaser of the applicable Wiper Blades.
•    ADC will not be responsible under this Limited Warranty or otherwise for defects or damage caused by any ancillary equipment not furnished by ADC which is attached to or used in connection with the Wiper Blades(s), and all such equipment is expressly excluded from this Limited Warranty, regardless if such damage is caused by use in connection with the Wiper Blades(s).
•    This Limited Warranty does not extend to any third-party products that buyer may use or purchase in conjunction with the Wiper Blades.
•    This Limited Warranty does not cover the cost of shipping outside of the Continental U.S. (as defined below); however, shipping within the Continental U.S. shall be at no cost to the customer. The “Continental U.S.” as used herein means the continental United States of America, and specifically excludes Alaska, American Samoa, Micronesia, Guam, Hawaii, Marshall Islands, Northern Mariana Islands, Palou, Puerto Rico, and the U.S. Virgin Islands.

2.3. How to Make a Claim under the Limited Warranty
PLEASE KEEP THE BOX THAT YOUR WIPER BLADES ARRIVED IN, ALONG WITH ALL ORIGINAL PACKAGING. IF YOU NO LONGER POSSESS THE ORIGINAL PACKAGING, YOU MAY SEND BACK THE WIPER BLADES IN YOUR OWN PACKAGING, PROVIDED IT IS ABLE TO SAFELY SECURE THE WIPER BLADES IN TRANSIT. HOWEVER, YOU MAY BE DISQUALIFIED FROM COVERAGE UNDER THIS LIMITED WARRANTY IF YOUR WIPER BLADES ARRIVES AT ADC’S WAREHOUSE WITH DAMAGE RESULTING FROM SHIPPING.

If your Wiper Blades were purchased from Costco and are still eligible for return under Costco’s return policy, please return the product directly to Costco.
After the expiration of Costco’s return policy, to make a claim under this Limited Warranty, you must contact us within the Warranty Period, and you will need to provide valid Proof of Purchase. To begin making a warranty claim, please contact ADC by emailing BFGoodrich@horizon-brands.com calling 1-877-880-2930 during ADC’s regular business hours (Monday through Saturday 8:00 am to 5:00 pm PST).

If ADC determines that your identified defect may be covered by this Limited Warranty, ADC will issue you a return material authorization (“RMA”), and you must then return the Wiper Blades in question to ADC using the instructions provided with such RMA and pre-paid shipping label to be provided by ADC with the RMA. ADC is not liable for Wiper Blades that are damaged or lost in transit if you fail to follow ADC’s shipping instructions. PLEASE SHIP YOUR WIPER BLADES TO ADC IN ITS ORIGINAL PACKAGING. IF YOU NO LONGER POSSESS THE ORIGINAL PACKAGING, YOU MAY SEND BACK THE WIPER BLADES IN YOUR OWN PACKAGING, PROVIDED IT IS ABLE TO SAFELY SECURE THE WIPER BLADES IN TRANSIT. HOWEVER, YOU MAY BE DISQUALIFIED FROM COVERAGE UNDER THIS LIMITED WARRANTY IF YOUR WIPER BLADES ARRIVES AT ADC’S WAREHOUSE WITH DAMAGE RESULTING FROM SHIPPING.

If ADC, in its reasonable discretion, determines that the Wiper Blades have a defect in materials or workmanship covered by this Limited Warranty, ADC shall replace the defective Wiper Blades at no cost to you (other than the cost of shipping outside of the Continental U.S., which shall be your responsibility). ADC will endeavor to provide you with the replacement offered hereunder within a reasonable period of time. 

2.4 Exclusive Remedy.
YOUR SOLE AND EXCLUSIVE REMEDY FOR DAMAGE OR DEFECT COVERED BY THIS LIMITED WARRANTY, AND OUR SOLE AND ENTIRE LIABILITY FOR SUCH DAMAGE OR DEFECT, IS FOR US TO REPLACE THE DEFECTIVE WIPER BLADES. 
FURTHER, ADC SHALL NOT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, NOR FOR ANY LOSS OF REVENUE, PROFIT, OR USE ARISING OUT OF A BREACH OF THIS WARRANTY. IN NO EVENT WILL ADC SOLUTIONS AUTO, LLC BE LIABLE FOR ANY AMOUNT GREATER THAN THE REPLACEMENT OF A DEFECTIVE WIPER BLADE. 

The disclaimers of liability included in this paragraph 2.4 shall remain in effect and shall continue to be enforceable in the event that any remedy herein shall fail of its essential purpose. 

SOME STATES MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THAT EXCLUSION MAY NOT APPLY TO YOU. 

This Limited Warranty gives you certain legal rights. You may have other rights that vary from state to state.

2.5. Unavailable Products
Although ADC will make all reasonable efforts to replace your Wiper Blades, however, in certain circumstances, an exact replacement of your Wiper Blades may not be available. In such circumstances, ADC will offer you an available similar model to the Wiper Blades that are the subject of your warranty claim (a “Like-Product”). The issuance of such Like-Product shall be deemed full satisfaction of your claim under the Limited Warranty. 

3. Returns Policy
If you are not satisfied with your Wiper Blades that was purchased from Costco, and such Wiper Blades are still eligible for return under Costco’s return policy, please return the Wiper Blades directly to Costco. ADC will not accept returns of Wiper Blades except as set forth in Section 2, above.

You agree and understand that it is necessary for ADC to collect, process and use your data to perform the services offered hereunder. ADC may contact you to inquire about your satisfaction with our service or to notify you about any Wiper Blades recalls or safety issues.
